Elvira and Saul Need Help - Stay of Deportation

A CALL TO ACTION to residents of Califas, from a friend and activist LaVerdad regarding Elvira Arellano and her son Saul. If you live in California, please join with us on this. With this effort I do think we can make a difference—a huge difference—to this family, and also in the larger challenge that this represents for immigrant families all over America. Please read:

We URGENTLY need your help. Elvira Arellano has brought attention to the crisis that exists in America today - one of forced family separation and one that no one can turn their back on. She has sacrificed so much for the love of her son and his pursuit of happiness, and his dreams that she believes can become a reality. Elvira has exemplified the need for family unity. We must stand behind efforts that embrace our U.S. citizens and their parents. Decisionmakers and lawmakers both have a moral conscience for family unity and we are appealing to that conscious. Elvira believes in all that is good and right in America and hopes that the decisonmakers and lawmakers will understand the issue of family separation as one of utter importance. Changing legislation to embrace family unity will be an example to our U.S. children that America stands by its moral values of justice and liberty for all.

This Mothers' Day benchmarked her refuge at the Adalberto Methodist Church in Chicago for almost 9 months. Elvira Arellano has a private bill introduced on her behalf by Congressman Luis Gutierrez (HR 1557). This bill would grant her permanent residency, if passed. Another private bill, sponsored by Congressman Bobby Rush (HR 2182) names Elvira and Illinois families would provide relief. Elvira boldly organized Illinois families facing similar situations throughout their campaign to uncover our country's crisis of policies that separate U.S. citizens from their parents.
Although both bills are requesting a grant for legal permanent residency for Elvira as well as others, they have no protection by way of a "Stay of Deportation" until the bill is marked up by the House Subcommittee on Immigration and Citizenship under the Judiciary Committee headed by Congressman Conyers.

At this time, we are yet not concerned with bringing this bill to a vote by Congress; rather we are looking for protection and relief for Elvira, and the others through a "Stay of Deportation", in order for her to spend quality time in the U.S. with her with her son in an environment conclusive to rearing children (while the process of legal permanent residency) takes its course. If the bills advanced to the Immigration and Citizenship Subcommittee, chaired by Rep. Zoe Lofgren (D-California), Elvira and others would be protected from deportation.

Elvira has made a selfless sacrifice by bringing this crisis to the attention of the world, making her and her son vulnerable to public scrutiny and bias sentiment and yet she has served as an example to her son, with her message: "family must retain its integrity and stay fully in tact for the physical and psychological stability of our children who by all definition are American." She has organized campaign efforts, lobbying, and mobilizing to provide Congress and Senate with "actual" information through her own personal case in order for them to create a just law for comprehensive immigration reform. Now, we need your help to free them and continue to put forth the necessary efforts that will bring the best legalization bill for family unity. We can win at this time. We know there is no substitute for an "actual" account of a family who has lived through forced separation brought upon them by unjust laws. Elvira represents an "actual" family that has been torn apart and she wants to tell her story to decision makers in hopes that family unity will take precedent. Please help us free Elvira to do the work set before her while she pleads for humane treatment and families and for a reformed comprehensive bill that represents true democracy, freedom and justice for all.

Our understanding is as follows: Congressman Conyers has agreed to have this bill marked up and call for the report from I.C.E. but Congresswoman Lofgren has decided, like most Congressman, that they will not entertain any private bills until they deal with Comprehensive Immigration Reform as a whole. These families make the argument for Comprehensive Immigration Reform. When Rosa Parks made the bold sacrifice to stay seated and not move she defied laws that encourage segragation and racism. Rosa created an American Legacy for the Civil Rights Movement to bring national attention to the crisis of racism and laws that would segregate American people by race. Rosa had at her disposal an entire legal defense and all of the consciously progressive electoral representatives so that she could continue to work and be an American symbol of strength and what is morally conscious. Elvira and her son deserve the same opportunity to continue working with families who are separated by policies that are not in the best interest of families or America.

We believe residents of California, with little effort, can convince Congresswoman Lofgren to entertain the bill and allow for Elvira Arellano win or lose the freedom to fight to stay with her son and for all those she represents. img I love the words about Rosa Parks. I think we do forget sometimes what real change takes. That even what eventually is seen as an obvious right that humans should share is, before that time, perceived as a niche concern by mainstream society—or not deserved at all, even. And that bucking that inertia is always—by definition—scary, and not "cool," or accepted at the time. That's what vision is for. And guts. And corazón. Elvira and Saul have these. Now they—and an important fight for human rights—need a hand.

Necesitamos su ayuda. Elvira Arellano ha convertido el asunto de separación de familias en algo al cual nadie pude ofrecer la espalda. Ha sacrificado tanto y tanto por el amor de su hijo, y para obligar a este país a que tome la responsabilidad por las familias que se formaron y los niños que nacieron acá por razón de las políticas de la gente que controlan a los Estados Unidos. El Día de las Madres había levado ya 9 meses en santuario en la iglesia Metodista Unida Adalberto en Chicago. Elvira tiene un proyecto de ley privado introducido en su nombre por el Congresista Luís Gutiérrez (HR 1557 ) y hay otro proyecto de ley, introducido por el congresista Bobby Rus h (HR 2182) que busca aliviar la situación de Elvira y de todo un grupo de familias en Illinois que ella ha organizado por medio de su campaña de revolucionar el problema de separación de niños nacidos acá de sus padres inmigrantes.

Aunque ambos proyectos de ley disponen la residencia legal permanente para Elvira y los demás, no hay protección en contra de la deportación para ellos hasta que el Subcomité de Inmigración y Ciudadanía de la Cámara de Representantes, que es parte del Comité de Asuntos Judiciales de la Cámara, hace un "markup" de los proyectos de ley, que quiere decir que se prepara para actuar sobre ellos.

En este mero momento no nos preocupa tanto que tomen un voto sobre los dos proyectos de ley; mas bien queremos que se gante una protección para Elvira y los demás por medio de una postergación de su deportación, para que ella puede disfrutar su tiempo con su hijo aquí mientras que el proceso legislativo continúe. Al avanzar los proyectos de ley en el Subcomité de Inmigración y Ciudadanía, cuyo presidente es la congresista demócrata por California Zoe Lofgren, esto podría lograrse.

Elvira ha hecho tremendos sacrificios convirtiendo a si misma y a su hijo, tanto que las otras familias que ella ha organizado, en ejemplos, por razón de sus situaciones personales, para ilustrar al Congreso la necesidad de una reforma integral de las leyes de inmigración. Ahora, necesitamos su ayuda para librarlos y para que puedan seguir luchando para lograr la mejor ley de legalización que sea posible. Sabemos que no hay nada mejor que la experiencia de una familia separada por las leyes injustas para explicar estas cosas a los legisladores. La situación como nosotros la entendemos es así: El Congresista Conyers está de acuerdo de que estos proyectos de ley sean hecho "mark up" que requiere que el Buró de Inmigración (ICE) presente un reporte sobre el asunto al Congreso. Pero como la mayoría de los congresistas, la sra. Lofgren prefiere de que todos proyectos de ley tocante a individuos específicos no sean considerados hasta que de bregue con una ley integral de reforma migratoria. Pero estas familias en si hacen el argumento a favor de una reforma integral. Cuando Rosa Parks hizo el valiente sacrificio de sentarse en aquel ómnibus y retar a las leyes injustas de racismo y segregación, el movimiento pro derechos civiles le puso a su disposición la mejor defensa legal posible, además de la ayuda de todos los representantes de consciencia progresista, para que Rosa pudiera seguir trabajando y siendo el símbolo del movimiento. Elvira merece lo mismo.

Creemos que ustedes en California con poco esfuerzo pueden convencer a la congresista Lofgren que tome en consideración estos proyectos de ley para que Elvira y los demás o ganan o pierden la libertad de luchar para seguir aquí con sus familias. I live in California, but I'm not in the 16th district. It won't take any e-mail from people whose zip codes do not fall in that area, and they say that "Due to ongoing security concerns on Capitol Hill, all mail sent to my Washington, D.C. office is delayed. Unfortunately, this means all constituent mail sent to Washington, D.C via the U.S. Postal Service will likely experience a delay in receiving a response back from me of a few weeks."

I will try faxing them instead. At least that works around here.

I tweaked the language a bit, and faxed it to both the DC and CA offices, then e-mailed my draft to the woman organizing the campaign. We do a lot of that here at the office, so it's old hat by now.

I just talked to Congresswoman Lofgren's staffers in her DC and California offices. The staffer in the California office said he was familiar with Ms. Arellano's story (but didn't know about the private bill) and that he would pass on the message. The DC staffer said he hadn't heard about her or the private bill. Both offices said they tend to prefer faxes or phone calls to written letters (since they get there quicker). Both staffers seemed sympathetic but had no idea what, if anything, the congresswoman will do.
