President Overlord II?

Categorized under Política Estados Unidos | Tags: , , ,

THERE'S SOME TALK lately about Michael Bloomberg running for President, and I've got four words for that thought.

Hell no.

and

"Operation Overlord."

And here's a few more:

[D]efendant Betts worked to persuade President Bush and the White House to hold the RNC on the West Side of Manhattan.

122. For example, the New York Times reported on January 14, 2005: “Mr. Betts, recalling that as the threat of protests grew, Mr. Bush took to tormenting him with comments like: ‘You’re ruining me politically. Why did you make me come to New York?’ Mr. Betts chuckled. ‘It was all good-natured,’ he said, ‘but I was thinking, ‘Oh my God, there’s probably a grain of truth in there. Should he have gone to Tampa?’’

123. Upon information and belief, defendants Betts and Bloomberg worked together to raise tens of millions of dollars worth of private finding. [...]

131. Upon information and belief, in approximately December of 2002, defendants Betts and Bloomberg had a dinner meeting with and Mr. Karl Rove, at or about which time the agreement that the defendant City would host the Republican National Convention was finalized. [...]

133. On or about January 6, 2003, the RNC Site Selection Committee recommended the City to host the 2004 RNC “for the first time in its history.”

134. Upon information and belief, on or about January 31, 2003, the announcement of defendant NYC as the host for the 2004 RNC “launched an extensive 19-month security coordination among City, State, and Federal entities.”

135. Upon information and belief, the United States Department of Homeland Security and/or other Federal agencies designated the RNC as a “National Security Special Event.”

136. Upon information and belief, in the year preceding the RNC, defendants Bloomberg, Kelly, Esposito,
Monahan, Colgan, DeRienzo, Spinella, Hammerman, Graham, and/or Smolka had numerous and frequent meetings with representatives from the United States Secret Service (“SS”), the United States Federal Bureau of Investigation (“FBI”), the New York City Fire Department, and the New York State Office of Emergency Management (“NYSOEM”) in connection with developing and implementing a plan for policing planned and unplanned protests during the RNC.

137. Upon information and belief, the United States Secret Service and defendant NYPD served as lead agencies “with support from the FBI, FEMA, various State and local enforcement authorities, and other related organizations” in this effort.

138. Upon information and belief, defendants called the operation “Operation Overlord II.”

139. Upon information and belief, in connection with the approximately 19-month “Operation Overlord II” planning effort, defendant NYPD acted in concert with unidentified City, State, and/or Federal law enforcement agencies to engage in unlawful and unwarranted surveillance of individuals they believed might come to New York City to demonstrate prior to and/or during the RNC.

140. Throughout 2003 and 2004, organizers across the United States and beyond planned protests during the week of August 30th to September 2, 2004.

141. Many utilized the internet to publicly announce planned, unpermitted demonstrations and other events.

142. Some groops and organizations, such as United for Peace and Justice, applied for formal parks and/or parade permits for massive, planned demonstrations.

143. Upon information and belief, throughout 2003 and 2004, defendant NYPD was monitoring and surveilling such plans on the internet.

144. For example, the New York Times reported on November 12, 2003 that, according to defendant Kelly, “the police [were] monitoring the Internet and the organizing groups, . . . . They want to know what groups are coming to New York, who their leaders are and what their plans are, long before anyone ever raises a billboard or turns on a bullhorn.” [...]

146. Upon information and belief, in connection with the approximately 19-month “Operation Overlord II” planning effort, defendant NYPD acted in concert with unidentified City, State, and/or Federal law enforcement agencies and determined to arrest and fully book individuals during the RNC for minor offenses such as disorderly conduct and parading without a permit, which are technically violations of law and not crimes, in contravention of normal NYPD procedures in connection with such offenses under which
arrestees are generally issued summonses (i.e., not arrested and fully booked).

147. In particular, defendants planned to engage in mass warrantless arrests as a means of crowd control and retaliation against individuals engaged in lawful, peaceful protest activity during the RNC.

148. Pursuant to New York State Criminal Procedure Law § 160.10(2), “a police officer who makes an arrest for any offense, either with or without a warrant, may take or cause to be taken the fingerprints of the arrested person. . . ”. See CPL § 160.10(2) (emphasis added).

149. Upon information and belief, in connection with the approximately 19-month “Operation Overlord II” planning effort, defendant NYPD acted in concert with unidentified City, State, and/or Federal law enforcement agencies and determined to systematically fingerprint those arrested for minor offenses during the RNC.

150. Upon information and belief, defendant NYPD subsequently planned to forward and actually forwarded those fingerprints (including plaintiffs’) to unidentified City, State, and/or Federal law enforcement agencies.

152. Upon information and belief, on or about March 11th, 2004, New York County District Attorney Robert
Morgenthau testified before the New York City Council during a budget hearing to the effect that “We also know that the Republican National Convention will bring significantly increased arrests in the weeks before the convention. NYPD anticipates that we could have up to 1,000 arrests a day.”

153. Accordingly, in 2003 and 2004, defendants were engaging in extensive surveillance of individuals and
groups they believed would come to NYC during the RNC to engage in protest activities.

154. So, well in advance of the RNC itself, defendants had fulsome intelligence - some of it obtained by the SS, FBI, and/or other City, State, and/or Federal agencies through the use of warrantless surveillance and/or the employment of undercover agents to infiltrate groups and gather intelligence about individuals perceived as protesters - regarding anticipated demonstrations and other protest activities.

155. Defendants planned to make “up to 1,000 arrests a day” in connection with RNC protest activities for minor offenses such as disorderly conduct and parading without a permit.

156. In ancitipation of those plans, the New York State Office of Court Administration (“OCA”) more than
doubled arraignment capacity, staffing four (4) day arraignment parts, four (4) night arraignment parts, and a midnight stiff.

157. The Office of the District Attorney of New York County added additional staff and kept its complaint room open extra hours.

159. Defendants’ mass arrest plans were maliciously designed and intended to punish and discourage dissent.

[...]

This is a civil rights action in which plaintiffs, who were arrested on August 31, 2004 at the height of the Republican National Convention (“RNC”) in NewYork City, seek relief in connection with defendants’ violation of plaintiffs’ rights secured by the Civil Rights Act of 1871, 42 USC § 1983, the United States Constitution, including its First, Fourth, Fifth, Sixth, Eighth, and Fourteenth Amendments, and by the laws and Constitution of the State of New York.

Plaintiffs seek damages, both compensatory and punitive, affirmative and equitable relief, an award of costs and attorneys’ fees, and such other and further relief as this Court deems equitable and just."

VERIFIED COMPLAINT AND DEMAND FOR JURY TRIAL___06-CV-2041, DENNIS KYNE, DUSTIN LANGLEY, and CHARLES DUNCAN, Plaintiffs, - against - PAUL WOLFOWITZ, SECRETARY OF THE DEPARTMENT OF DEFENSEOF THE UNITED STATES OF AMERICA; THE CITY OF NEW YORK (“NYC”), a municipal entity; THE NEW YORK CITY POLICEDEPARTMENT (“NYPD”); THE NEW YORK CITY DEPARTMENT OF CORRECTIONS (“NYCDOC”); THE HUDSON RIVER PARK TRUST (“HRPT”), a joint City-State body; CONNIE FISHMAN, HRPT PRESIDENT; THE REPUBLICAN NATIONAL CONVENTION HOST COMMITTEE (“RNCHC”); ROLAND BETTS, CO-VICE CHAIR OF THE RNCHC; NYC MAYOR MICHAEL BLOOMBERG; MARTIN HORN, NYCDOC COMMISSIONER; JORGE OCASIO, NYCDOC WARDEN; RAYMOND KELLY, NYPD COMMISSIONER; JOSEPH ESPOSITO, NYPD CHIEF OF DEPARTMENT; STEPHEN L. This is Michael Bloomberg's idea of justice. And of how to spend his constituents money. And of law. And of freedom. Him in the white house? Nah, I think we've seen where these beliefs are leading us. We can't afford any more.

And on the larger tip, I hope we all continue to add all this up. We need all of us, all our memories, all our stories, all our blogs, all our cameras, all our hope, and all our fury. We need to remember this, along with this, and this, and this and this.... These aren't to be dismissed as random and unrelated incidents. The MSM Press squashes these stories, and when it doesn't, it deftly de- and re-contextualizes and/or isolates and minimizes them. Without the Internet and phone calls, many people wouldn't even see a larger pattern coming together. But along with Bombocracy, the USA is also a chief exporter of home-grown ignorance, and of course the MSM and those who who fund MSM outlets generally do not want us to see these patterns. I was amazed that so little people knew of these mass arrests in NYC. And many still do not! But these arrests rocked the city. For days. For much longer, given the fallout. They were historically unprecedented. They were cruel, they were illegal, they were anti-American, and and worst of all, I feel they were practice for....

And who was at the helm?

Michael Bloomberg. "Moderate." "Independent." "From the Center." Not in my experience. Not even close to the center. Unless you are talking about the center of a Police State.

Thanks for covering this. I was one of the people down at the pier 57 gulag, along with some good friends of mine and people who became friends. Several more of my friends and comrades got subpoenas to grand juries to be convened during the same time as the convention. There were something like 1800 people at pier 57, and that scale of arrests, even absent any personal testimony of ours, should be enough to show that these arrests were not all for any legitimate cause. So too should the fact that the vast majority of us had our cases dropped as soon as the convention ended.

I can't understand why Bloomberg thinks he stands a chance running for president—Giuliani has the police state-generating New York mayor niche already sewn up.

well, i think it may be because we all know rudy is for police brutality and war. but bloomberg pretends to be all moderate, as i wrote. and, for the most part, appears to be. yet, this issue i highlight here (i was both in the tombs and in pier 57 as well, if you click the first "Operation Overlord" link, you'll see i wrote about it a bit more in depth) is mostly unknown about on a national scale.

yes, most cases were dropped immediately, and the city lost almost every other single case, or ACD'd them. i think they are still dealing with class action suits over it. and to see it is illegal, well...just read some of that order i quoted above! they were spying on people! months before the conventions! planning it all, funding it, and then failing woefully at providing even basic needs like water or a cot, much of the time. and then laying about planning it. but it was all planned, and being in pier 57, too, i know from talking to many peeples there how innocent some were—even of knowing exactly what they got caught up in! a fella i was talking to had only been picking up milk on one of the street they made one of their "net-arrests" (16th).

they clamped those plastic zip cuffs on me so tight my hand got numb for hours even after they took them off. they didn't care, and they wouldn't let me report it, and they wouldn't take a note of it.

so thank you, and of course, you are welcome.

GAH! what is this, the nazis of new york run for prez? first guiliani, now this?

i moved to new york a few years before it got messy - guiliani destroyed so much of the culture we actually thought bloomberg would be an improvement, but he turned out to be a sly bastard. letting the RNC in was an absolute insult to the people of new york. when the WTC attack happened bloomberg seemed pretty invisible - and guiliani returned to make a "heroic appearance" for no apparent reason. scary!

my last week there was spent in jail during the republican national convention. i was arrested on 16th street (as commented on by the poster above), kept in pier 57 for two days and kept in jail illegally for another three (misdemeanor, supposed to let you go after 24 hours). i'd done nothing, was LEGALLY standing on the sidewalk (unless that's illegal now). yeah there are still some class action lawsuits going on, you better believe it! it was all so dirty - they kept us in jail illegally so bush could fly in and make his speech unimpeded by people seeking justice.

a few years later as i was leaving mexico (my heart still hurts!) i arrived in mexico city to a 3 million person weeks-long protest, peacefully occurring in the streets - even the cops seemed to be on the side of the people, walking around smiling. it was so amazing to be able to walk the streets and talk with people about how so many of us were fighting for the same exact things north of the border. the more we talked the more everyone realized how insidious the media is at keeping us ignorant and hateful of each other (i think i might have even managed to score a couple of "not such a bad gringa" points). communicating with each other is how it gets done, folks - i couldn't imagine an easier way for me to leave mexico than riding on a big fat onda de la solidaridad.

Not even close to the center. Unless you are talking about the center of a Police State.

Most people are quite content to live in a police state. Witness our immigration system, where police actions like the RNC occur on a regular basis. Anything to keep "them" off our streets and "us" safe peering out from behind our picket fences.

But a Bloomberg candidacy would be a joke--he'd poll below both Tancredo and Kucinich. Probably few outside of NYC even know who he is. He's the choice of the Broders of DC and nobody else.

OK, Nez, you shoot, you score. In some emails I did say I was for Bloomberg, but I am glad you reminded me of this police action from the Convention which is just more evidence that my memory is shot. So, keep up the great work and I look forward to your comments after the next few primaries.
Anything to observe about Kenya? I am curious if any of the readers might be from there and give an inside view. It seems that it is all about tribalism, a common problem throughout the world. In fact, it wasn't so long ago that in South Africa and Rhodesia Caucasians were referred to as The White Tribe.
I think we are seeing the rise of serious tribal problems in the US and I do not mean Lakota Nation or tribes based on skin color.
I think it is more the experience you had when sent to the Tombs. The tribes of political preference and religious leanings are growing and economic tribalism can't be far behind.
In my case, I will have to start doing some mental pumping up to get my memory functioning in better fashion.

i have the kenya thing on draft post!!

cool, i hear you on bloomberg. if it werent for that one incident, even as a nyc resident, i would have been like "eh, he wasn't so bad" myself. but that showed a lot about him. i mean a lot. very uncool. we were very unhappy with him.

sadly, you are probably right, yave. about wha tmost poeple would setlle for.

RC, I'm not from Kenya, but I recommend the blog Thinker's Room for a native Kenyan voice on the troubles. I first found him during Bob Geldof's Live 8 thing in Scotland two years ago, where he had an excellent couple of posts up critiquing the whole thing (see, for example, "Get Real: Global Politics 101 & Live 8").
