NEW YORK - A police officer who body-slammed an unarmed woman and broke her jaw during a medical call to a suburban restaurant last year was arrested Friday and charged with civil rights violations.
Federal prosecutors said Yonkers officer Wayne Simoes used excessive force when he grabbed the woman by the waist, hoisted her in the air and slammed her, face first, into a tile floor.The takedown [isn't this rich, sounds like a football conversation --Nezua] recorded March 3, 2007, by security cameras, knocked Irma Marquez unconscious [remember, it was the takedown that knocked her out, not the police officer] and put her in the hospital for four days. At the time, authorities said the officer was trying to keep her from interfering with emergency medical technicians summoned to the restaurant to assist her niece, who had been hit in the head with a bottle.
It's rather surreal if you try to play it out in your mind. No matter how you try to frame pulling a WWF move on a woman that leaves her without a working face, it's hard to make it sound sane, absent a detonator in her hand or something.
So they are going for the "mental magic" defense. Something like "When I smashed your aunt into the tile floor I was thinking of little happy birdies and smiley faces, I swear!"
Simoes, 38, said little Friday during his arraignment. A magistrate released him on bond. His attorney, Andrew Quinn, said Simoes intends to plead not guilty."I've also seen the video, and I know what it shows. But what the video doesn't show is the operation of Wayne Simoes' mind at the time of this incident," Quinn said. He said Simoes didn't intend to violate the woman's rights or "cause any type of injury."
Simoes could get years in prison if convicted. The Yonkers Police Department said it had placed him on modified duty pending the outcome of the case.
Despite the nature of Marquez's injuries, which included a broken jaw and bruises over her entire face, law enforcement authorities initially sided with the officer.
Wow, that's surprising. I would not have expected that.
And despite whatever the hell was Operating in Wayne Simoes' Mind, I'm glad to see this justice done. It's the least that should be done in the service of justice, the very least.
I thought they trained these people with martial art moves, hapkidos and such? Joint submission locks and stress holds and all? And this is the best you can do in making someone submit? Pick a woman up in the air by her waist, "hoist" her and "slam" her down "face first" into a tile floor. Completely smash her face, break her bones. Hospitalized for four days. You're a fucking sadist, sorry. You had her in control, you had her up in the air, you could have chosen to throw her outward, or place her elsewhere. You chose to slam her into the ground full force like she was some helpless thing perversely deserving your unchecked aggression.
You won't enjoy the other side of the cage, I'll bet. Won't pretend I feel sorry bout that.

I'm sure the PUBLIC SAFETY OFFICIAL involved in this "alleged" altercation did not intend to hurt anyone or deprive them of their rights. I'm sure that he only resorted to his mischaracterized attempt to non-violently subdue this very dangerous woman after she had refused, repeatedly, his several polite entreaties to "STFU and get out of here!". I certainly can see his side of this, just another hardworking, overworked, underpaid...USA!USA!!USYAY!!!! Oh, sorry, I get worked up when I think about how hard some poor cops work to bridge the societal divide between the "haves and the have knots (contusions, hematomas and fractures)".

I'm not surprised, I live in Yonkers. I don't know the woman who was assaulted, clearly her experience was brutal. This case happened so long ago, I didn't hear about it until recently. I'm glad she got the competent legal aid she was entitled to. Hopefully she'll win the suit she filed against the city.
This kind of psychotic behavior from YPD officers is unfortunately not out of the ordinary. They target victims particularly women and POC, for abuse, seek out violent confrontation with peaceful citizens, and attempt to criminalize the daily lives of the poor.
Yonkers is being marketed as a up and coming neighborhood that is slowly gentrifying, starting with the waterfront. Building projects meant to attract young white couples required a sharp increase in police activity to 'drive out crime.' Funny, since in Yonkers the cops are the criminals. Lately, the waterfront is where POC work, and white people live. The long time residents of Yonkers are not seeing the benefits, are not the intended beneficiaries of these 'resurgence' projects. They are being driven out of their neighborhoods, and replaced by more desirable residents. Clearly, YPD is as eager as ever to use violence.
To the commenter above: In a culture of sadism, POC are not immune to committing violence. Just like white folks.
